THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES CURRENTLY RESIDING IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO) WHO ARE EIGHTEEN (18) YEARS AND OLDER AS OF APRIL 24, 2007 WITH INTERNET ACCESS AS OF APRIL 24, 2007 AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.  DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA .

 

1. HOW TO ENTER: Edy’s® Dibs® ice cream snacks is looking for  Americans nationwide to nominate their workplace for the Dibs Quest For A Cooler Workplace™ by sending their entry via mail (see details in Section 2) or via email by visiting www.Dibs.com between April 24, 2007 at 12:00 AM (ET) through August 5, 2007 at 11:59 PM (ET) and including:

 

a.       A short paragraph (using no more than 350 words) explaining what you are doing to make your workplace cooler.

 

b.      Each entrant must also include his/her name, workplace name, workplace mailing address, evening phone number, date of birth, and email address.  An official online entry form is available at www.Dibs.com.

 

c.       Incomplete entries will be disqualified and discarded upon receipt without further consideration and without notification to entrants.

 

2.      MAIL ENTRIES:  All entries, regardless of whether your entry is sent via the Internet or sent by regular mail, must be received or time stamped by 11:59 p.m. ET on August 5, 2007 to be eligible for entry. Completed mail-in entries should be sent to:

Damaged, mutilated or otherwise illegible entries will be disqualified and discarded upon receipt without further consideration and without notification of entrants.

 

 

3. JUDGING:   Judging will be completed by a panel of experts.  The Panel will review all eligible entries submitted online and via mail and will select the top three hundred fifty (350) entries to receive the Dibs Quest For A Cooler Workplace™ grand prize package listed in Section 5 (Grand Prize Package). 

 

Judging will be based on the following criteria: 

 

-         Originality/Creativity                                               25%

-         Enthusiasm                                                 25%

-         What makes your workplace special                       50%

 

All decisions of the judges shall be final and shall not be subject to any review.

 

4.      WINNERS AND WINNER NOTIFICATION: Three hundred fifty (350) Grand Prize winners each will receive the grand-prize package listed below and will be notified on or about the week of August 13, 2007 to the email or mailing address provided with the entry.  Limit one prize per workplace or address. 

 

5.      GRAND PRIZE PACKAGE:  Each winning entrant will be required to sign and have notarized an affidavit/prize acceptance/release of liability form to receive a grand prize package consisting of the following:

 

-         A bunker-style freezer (49”W x 26”D x 36”H) rental for one month ($540 ARV)

-         Seventy-two (72) 9oz. containers and one hundred fifty-six (156) 4oz. containers of Edy’s® Dibs® bite sized ice cream snacks ($1,933.56 ARV)

-         Total Retail Value for each grand prize winner is $2,473.56.00 [Total approximate retail value for all grand prize winners is $865,746].

 

Product prize will be divided into three equal quantities and distributed to winner in three shipments which will be placed inside the bunker-style freezer.

 

Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected.

 

6. PRIZE RESTRICTIONS: Prizes are non-transferable.  No substitution or cash equivalent of the prizes will be granted except at Edy’s sole discretion.  All taxes not specified are the responsibility of the winners, and a 1099 tax form will be provided to winners for tax purposes.  Edy’s reserves the right to substitute prize of equal or greater value.  Limit one prize per workplace or address.  Winner’s workplace must be able to accommodate a bunker-style freezer with dimensions 49”W x 26”D x 36”H for one month and have a continuous power source (regular 110V outlet) for the duration of that month.  Grand Prize winner must receive permission from his/her company or employer to have the freezer on company property, and an authorized party at that company must agree to a bunker lease agreement for the duration of the time that the freezer is used.  A refundable deposit may be required. Standard electricity rate charges will apply, and are the responsibility of the company.  Freezer will be delivered by Edy’s Grand Ice Cream. to winner’s workplace on a mutually-agreed-upon date by sponsor and winner no later than September 30, 2007, and will contain twenty-four (24) 9oz. containers and fifty-two (52) 4oz. containers of Edy’s® Dibs® bite sized ice cream snacks.  Winner will receive two subsequent deliveries of Edy’s Dibs ice cream snacks: first subsequent delivery will be approximately 10 days after initial freezer delivery, and second subsequent delivery will be approximately 20 days after initial delivery.  The two subsequent deliveries will each contain twenty-four (24) 9oz. containers and fifty-two (52) 4oz. containers of Edy’s® Dibs® bite sized ice cream snacks provided that the freezer is empty and able to accommodate these containers.  If the freezer is not empty, it will be filled to capacity and winner will forfeit any containers of Edy’s Dibs ice cream snacks that do not fit into the freezer at that time.  Freezer remains the property of Edy’s Grand Ice Cream and may not be used for any purpose other than to hold Edy’s Dibs ice cream snacks.  Freezer will be picked up by Edy’s Grand Ice Cream on a mutually-agreed-upon date by Sponsor and winner approximately one month after freezer is initially delivered.  Damaged or broken freezers may be subject to a fee determined by Sponsor.

 

7. GENERAL RULES: Open only to legal residents of the United States ages eighteen (18) years and older as of April 24, 2007. Employees of Edy’s, directors, officers, affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household are not eligible. Void where prohibited by law.  All federal, state, and local laws and regulations apply. By submitting an entry, you acknowledge and agree that your entry is your original work and understand that it becomes the sole and exclusive property of Edy’s Grand Ice Cream (“Edy’s”) and acceptance of a prize constitutes permission to Edy’s and its agencies to use the winning Quest Contest winner's name and likeness for purposes of advertising, promotion and trade without further compensation unless prohibited by law.  However, the addresses, telephone numbers, and email addresses of entrants will not be sold or otherwise provided to any third parties.  By participating in this contest, entrants expressly acknowledge compliance with these Official Rules, and waive all right to, and hold harmless, Edy’s and its advertising and promotions agencies from any loss, damage or expense arising out of or in connection with participation in this contest or the acceptance, use or misuse of any prize. Return of any prize notification as undeliverable will result in disqualification and an alternate winner may be selected. By participating in this promotion, entrants agree to be bound by the Official Rules. Edy’s is not responsible for any typographical or other error in the printing of the offer, administration of the promotion or in the announcement of the prizes. 

 

8. OTHER CONDITIONS:  Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature.  Sponsor reserves the right in its sole discretion to cancel or suspend this contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the contest.  Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the contest by any technical or human errors which may occur in the processing of the entries in the contest.  Sponsor reserves the right to withdraw the transmission of this contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal.  Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Rules.

 

9. LIST OF WINNERS: A list of winning entrants will be available online at www.Edys.com or send a self-addressed-stamped envelope to Dibs Quest For A Cooler Workplace™ 5929 College Avenue, Oakland, CA  94618 .  Requests must be received by June 30, 2007.
